Montecalvo, of Rhode Island, to be United States Circuit Judge for the First Circuit, post-cloture. At approximately 11:30am, the Senate will vote on confirmation of the Montecalvo nomination. Following disposition of the nomination, the Senate will vote on the motion to invoke cloture on Executive Calendar #1032 Sarah A. L. Merriam, of Connecticut, to be United States Circuit Judge for the Second Circuit. An additional roll call vote is possible during Wednesday’s session of confirmation of the Pekoske nomination (Administrator of the Transportation Security Administration). Another message will be sent if that vote is scheduled.

12:29 p.m. By a vote of 47-50, the Senate did not confirm the Freeman nomination. Senators Duckworth, Hassan, and Young did not vote. Leader Schumer changed his vote to No and entered a motion to reconsider the failed confirmation vote.
11:37 a.m. The Senate began a roll call vote on confirmation of the nomination of Arianna J. Freeman to be a U.S. Circuit Judge for the Third Circuit.
