Following leader remarks, the Senate will resume consideration of the nomination of Emery Kidd to be a US Circuit Judge for the 11th Circuit. At 5:30 p.m. the Senate will vote on confirmation of Emery Kidd to be a US Circuit Judge for the 11th Circuit.

2:46 p.m. By a vote of 49-44, the Senate invoked cloture on the nomination of Embry J. Kidd to be United States Circuit Judge for the Eleventh Circuit.

  • Senator Manchin voted against.
  • Senators Braun, Cardin, Cassidy, Kennedy, Moran, Rubio and Vance did not vote.

1:39 p.m. The Senate began a roll call vote on the motion to invoke cloture on the nomination of Embry J. Kidd to be United States Circuit Judge for the Eleventh Circuit.

1:37 p.m. Senator Scott (FL) achieved unanimous consent to pass S. Res. 874 A resolution honoring the Southeast Region Little League baseball team from Lake Mary, Florida, for winning the 2024 Little League Baseball World Series.

1:34 p.m. Majority Leader Schumer filed cloture on the following nominations:

  • Mustafa Taher Kasubhai to be United States District Judge for the District of Oregon.
  • Sarah French Russell to be United States District Judge for the District of Connecticut.
  • Rebecca L. Pennell to be United States District Judge for the Eastern District of Washington.

1:30 p.m. By a vote of 50-46, the Senate confirmed the nomination of David Huitema to be Director of the Office of Government Ethics for a term of five years. It was a party line vote. Senators Cardin, Cassidy, Kennedy, and Vance did not vote.

12:46 p.m. The Senate began voting on confirmation of David Huitema to be Director of the Office of Government Ethics for a term of five years.

12:43 p.m. By a vote of 59-37 the Fung nomination was confirmed. Republicans voting aye: Collins, Cornyn, Cramer, Crapo, Murkowski, Risch, Romney, Tillis, and Young. Not voting: Cardin, Cassidy, Kennedy, and Vance.

11:37 a.m. The Senate began a roll call vote on confirmation of Cathy Fung to be a Judge of the United States Tax Court for a term of fifteen years.

11:08 a.m. Senators Tillis, Budd, and Warner spoke on the devastation in North Carolina and Virginia after Hurricane Helene. Senator Tillis asked unanimous consent for the Senate to pass H.R. 6651, and the Tillis-Warner substitute. Senator Paul objected and asked unanimous consent to modify the request and include an amendment. Senator Tillis objected to the modification. Senator Warner spoke on the H.R. 6651.

10:59 a.m. Senator Thune spoke on the 2024 elections and Senate leadership election.

10:30 a.m. Republican Leader McConnell spoke about leadership and thanked additional Senate staff.

At 11:30 a.m. the Senate will proceed to a series of two votes:
1. Confirmation of the Fung nomination.
2. Confirmation of the nomination of David Huitema to be Director of the Office of Government Ethics.

At 1:45 p.m. the Senate will vote on cloture on the nomination of Emery Kidd to be a US Circuit Judge for the 11th Circuit.
